Daleel: Divorce is Lawful and Clean

The following hadith about divorce is not authentic. In fact it is a lie:

Ali ibn Abi Taalib (may Allaah be pleased with him), that the Prophet (peace and blessings of Allaah be upon him) said: “Do not issue divorce, for the Throne shakes because of divorce.” Narrated by Ibn ‘Adiyy in al-Kaamil (5/112) and by al-Khateeb in Tareekh Baghdaad (12/191), and via Ibn al-Jawzi in al-Mawdoo’aat (2/277), via ‘Amr ibn Jumay’ from Juwaybir from al-Dahhaak from al-Nazzaal ibn Sabrah from ‘Ali ibn Abi Taalib (may Allaah be pleased with him).

Ibn al-Jawzi said:

It is a mawdoo’ (fabricated) hadeeth… ‘Amr ibn Jumay’ used to narrate munkar ahaadeeth from prominent people, and mawdoo’ ahaadeeth from sound narrators.

He was as da’eef (weak) and a fabricator by many scholars, including the following:

Al-Khateeb al-Baghdaadi in Tareekh Baghdaad (12/187), Ibn al-Qaysaraani in Dhakheerat al-Huffaaz (2/1147), al-Sakhaawi in al-Maqaasid al-Hasanah (p. 31), al-Shawkaani in al-Fawaa’id al-Majmoo’ah (p. 139), al-San’aani and al-‘Ajlooni in Kashf al-Khafa’ (1/361), and al-Albaani in al-Silsilah al-Da’eefah (1/278, hadeeth no. 147).

Allah does not hate anything that he made lawful. He only hates that which he made unlawful and the true believer would never make unlawful that which Allah made lawful:

'Those who believe do not make unlawful the good things which Allah has made lawful for you, and do not transgress. Allah does not like trangressers" - Muslim

Also Everything lawful is good and clean whereas whatever is unlawful is bad and dirty:

"Apart from what is lawful and good, all other things are unlawful and not good (unclean Al-Khabith)" - Muslim

Whoever tells you that a woman can not seek divorce (Khula) in islam is a liar and needs to fear allah.

What islam forbids is seeking a divorce for no reason. If you have a reason then it is lawful.

Proof of this is found in the sunnah when the ex wife of Rifa'a Al-Qurazi was granted Khula from her husband by the prophet (sa) - Bukhari

Allah is merciful and would never put us in a situation of no way out. Be careful of people who speak about this religion without knowledge and are ignorant enough to challenge those who do have knowledge.

  1. Alhamdulillah that Islam allows divorce. Even though I am not married now and hope that I will never have to go through a divorce, it is good to know that I will always have it as an option if things just don't work out (or if, ALLAH forbid, my husband is neglectful or abusive). I have never heard that fake hadith about marriage being unlawful; I mean, it so clearly says in the Qur'an that divorce is halal (though disliked) that it's ridiculous that people would actually think that it is haram.

  2. Yes, some Muslims are very ignorant of their religion sis. So man. There are Muslims that believe non-Muslims will be joining Muslims in paradise. It doesn't make sense.
